1973年干预公海非油类物质污染议定书(附英文)

(1973年11月2日订于伦敦。本议定书于1983年3月30日生效。中华人民共和国于1990年2月23日交存加入书。本议定书于1990年5月24日对我生效。)

 

            全文

    本议定书各缔约国,

    作为1969年11月29日在布鲁塞尔签订的国际干预公海油污事故公约的缔约国,

    考虑到1969年海洋污染损害国际法律会议所通过的关于非油类污染物的国际合作决议,

    还考虑到,按照该项决议,政府间海事协商组织*与一切有关的国际组织合作,已加强了其在非油类污染物的各个方面的工作,兹协议如下:

            第一条

    1.本议定书的缔约国,在发生海上事故或与这种事故有关的行为后,如有理由预计到将造成重大的有害后果,则可在公海上采取必要的措施,以防止、减轻或消除由于非油类物质造成污染或污染威胁而对其海岸或有关利益产生的严重而紧迫的危险。

    2.第1款中所指的非油类物质为:

    (1)列于由本组织指定的适当机构所制订的名单中的物质,该项名单应作为本议定书的附件,以及

    (2)其他易于危害人类健康,伤害生物资源和海生物、损害休憩环境或妨害对海洋的其他合法利用的物质。

    3.每当进行干预的缔约国就上述第2款第(2)项中所述物质采取行动时,该缔约国有责任确证,该物质在进行干预时的情况下,会产生类似于上述第2款第(1)项所述名单中列举的任何物质所产生的严重而紧迫的危险。

            第二条

    1.1969年干预公海油污事故公约第一条第2款和第二至八条以及其附件的规定,应如同其适用于油类一样,适用于本议定书第一条中所述的物质。

    2.就本议定书而言,该公约第三条第3款和第四条中所述的专家名单应予扩大,以包括能在非油类物质方面提供意见的专家。其人选由本组织的会员国和本议定书的缔约国提出。

            第三条

    1.第一条第2款第(1)项中所述的质物名单,应由本组织指定的适当机构保持常新。

    2.本议定书的任一缔约国对该名单所提议的修正案,应提交本组织,并由本组织在该适当机构对之进行审议前至少3个月转发给本组织的所有会员国和本议定书的所有缔约国。

    3.本议定书的缔约国,不论其是否为本组织的会员国,均有权参加该适当机构的会议。

    4.修正案须以到会并投票的本议定书缔约国的2/3多数票通过。

    5.修正案如按上述第4款的规定获得通过,则本组织应将其通知本议定书的所有缔约国,以供接受。

    6.该修正案,在通知后满6个月时,应视为已被接受,除非在此期限内有不少于1/3的本议定书的缔约国通知本组织表示反对。

    7.凡按上述第6款规定视为已被接受的修正案,应在其被接受后过3个月,对本议定书的所有缔约国生效,但对在该日期前声明不予接受者除外。

            第四条

    1.本议定书对已签署或已加入第二条中所述公约的国家和被邀请出席1973年国际海洋污染会议的国家开放供签字,并自1974年1月15日起至1974年12月31日止在本组织总部继续开放供签字。

    2.除本条第4款的规定外,本议定书须经已签字的国家批准、接受或认可。

    3.除第4款的规定外,本议定书应对未签字的国家开放供加入。

    4.本议定书只可由业已批准、接受、认可或加入第二条中所述公约的国家批准、接受、认可或加入。

            第五条

    1.批准、接受、认可或加入,须以相应的正式文件交存本组织秘书长。

    2.在本议定书的一项修正案已对所有现有缔约国生效之后或者在为该项修正案对所有现有缔约国生效所需的一切措施均已完成之后交存的任何批准、接受、认可或加入的文件,应认为适用于按该修正案所修订的本议定书。

            第六条

    1.本议定书应在已有15个国家向本组织秘书长交存批准、接受、认可或加入文件之日后第90天生效,但本议定书不得在第二条中所述的公约生效之前生效。

    2.对于随后批准、接受、认可或加入本议定书的每个国家,本议定书应在该国交存相应的文件后第90天对之生效。

            第七条

    1.本议定书的任何缔约国,可在本议定书对之生效之日后,随时退出本议定书。

    2.退出本议定书须以相应的文件交存本组织秘书长。

    3.退出本议定书,应在将退出文件交存本组织秘书长后经过1年或该文件中所指明的较长期限届满后生效。

    4.本议定书的一缔约国退出第二条所述的公约,即应视为也退出本议定书。这种退出,应在按照该公约第十二条第3款退出该公约生效之日同时生效。

            第八条

    1.本组织可召开修订或修正本议定书的会议。

    2.在有不少于1/3的本议定书的缔约国提出要求时,本组织应召开缔约国会议,以修订或修正本议定书。

            第九条

    1.本议定书应交本组织秘书长保存。

    2.本组织秘书长应:

    (1)将下列情况通知所有已签署或加入本议定书的国家:

    ①每一新的签字或文件的交存,以及其日期;

    ②本议定书生效的日期;

    ③任何退出本议定书的文件的交存以及退出生效的日期。

    ④对本议定书或其附件的任何修正案,以及对该修正案的任何反对或不予接受的声明;

    (2)将核证无误的本议定书的副本分送给已签署或加入本议定书的所有国家。

            第十条

    本议定书一经生效后,本组织秘书长应即按联合国宪章第一百零二条的规定,将核证无误的副本一份送联合国秘书处登记和公布。

            第十一条

    本议定书正本1份,用英文、法文、俄文和西班牙文写成,四种文本具有同等效力。

    经正式授权的下列具名代表特签署本议定书,以昭信守。

            附件本组织海上环境保护委员会根据第一条第2款第(1)项制订的物质名单

    

    国际海事组织于1973年11月23日在其第八届大会上以决议A·296(VIII)指定海上环境保护委员会为本议定书第一条第2款第(1)项所述的适当机构。海上环境保护委员会经过审议,于1974年11月21日以决议MEPC·1()通过了此附件。

   PROTOCOL RELATING TO INTERVENTION ON THE HIGH  SEAS  IN  CASES  OFMARINE POLLUTION BY SUBSTANCES OTHER THAN OIL 1973 *

            

            Whole document

    

    [*1. Ratification by the Nether lands was declared to be effective in

respect of the Netherlands Antilles.

    2. Ratification by the United kingdom was declared to be effective in

respect of Bermuda. With effect from May 5. 1981.

    3. The Preamble. Articles and Testimonies of the Protocol were done by

the International Conference on Marine Pollution in London on November 2.

1973 For the text of the Final Act of the Conference. see IMCO Publication

77. 14E. The Annex to the Protocol (see page 22) was adopted by the Marine

Environment Protection Committee of the Organization by Resolution MEPC. I

(II) of November 21. 1974, that Committee having been designated by the

Assembly of the Organization as the body referred to in paragraph 2 (a) of

Article I of the Protocol (Assembly Resolution A 296 (VIII) of November 23

(1973).]

    The Parties to the present Protocol,

    Being Parties to the International Convention relating to Intervention

on the High Seas in Cases of Oil Pollution Casualties, done at Brussels on

November 29, 1969.

    Taking into account the Resolution on International Co-operation

Concerning Pollutants other than Oil adopted by the International Legal

Conference on Marine Pollution Damage, 1969.

    Further taking into account that pursuant to the Resolution, the

Intergovernmental Maritime Consultative Organization has intensified its

work in collaboration with all interested international organisations, on

all aspects of pollution by substances other than oil,

    Have agreed as follows:

 

            Article I

    

    1. Parties to the present Protocol may take such measures on the high

seas as may be necessary to prevent mitigate or eliminate grave and

imminent danger to their coastline or related interests from pollution or

threat of pollution by substances other than oil following upon a maritime

casualty or acts related to such a casualty, which may reasonably be

expected to result in major harmful consequences.

    2. "Substances other than oil" as referred to in paragraph 1 shall be:

        (a) those substances enumerated in a list which shall be

established by an appropriate body designated by the Organization and

which shall be annexed to the present Protocol, and

        (b) those other substances which are liable to create hazards to

human health, to harm living resources and marine life. to damage

amenities or to interfere with other legitimate uses of the sea.

    3. Whenever an intervening Party takes action with regard to a

substance referred to in paragraph 2 (b) above that Party shall have the

burden of establishing that the substance,  under the circumstances

present at the time of the intervention. could reasonably pose a grave and

imminent danger analogous to that posed by any of the substances

enumerated in the list referred to in paragraph 2 (a) above.

 

            Article II

    

    1. The provisions of paragraph 2 of Article I and of Articles II to

VIII of the Convention Relating to Intervention on the High Seas in Cases

of Oil Pollution Casualties, 1969, and the Annex thereto as they relate to

oil, shall be applicable with regard to the substances referred to in

Article I of the present Protocol.

    2. For the purpose of the present Protocol the list of experts

referred to in Articles III (c) and IV of the Convention shall be extended

to include experts qualified to give advice in relation to substances

other than oil. Nominations to the list may be made by Member States of

the Organization and by Parties to the present Protocol.

         Article III

    

    1. The list referred to in paragraph 2 (a) of Article I shall be

maintained by the appropriate body designated by the Organization.

    2. Any amendment to the list proposed by a Party to the present

Protocol shall be submitted to the Organization and circulated by it to

all Members of the Organization and all Parties to the present Protocol at

least three months prior to its consideration by the appropriate body.

    3. Parties to the present Protocol whether or not Members of the

Organization shall be entitled to participate in the proceedings of the

appropriate body.

    4. Amendments shall be adopted by a two-thirds majority of only the

Parties to the present Protocol present and voting.

    5. If adopted in accordance with paragraph 4 above, the amendment

shall be communicated by the Organization to all Parties to the present

Protocol for acceptance.

    6. The amendment shall be deemed to have been accepted at the end of a

period of six months after it has been communicated, unless within that

period an objection to the amendment has been communicated to the

Organization by not less than one-third of the Parties to the present

Protocol.

    7. An amendment deemed to have been accepted in accordance with

paragraph 6 above shall enter into force three months after its acceptance

for all Parties to the present Protocol,  with the exception of those

which before that date have made a declaration of non-acceptance of the

said amendment.

 

            Article IV

    

    1. The present Protocol shall be open for signature by the States

which have signed the Convention referred to in Article II or acceded

thereto, and by any State invited to be represented at the International

Conference on Marine Pollution 1973. The Protocol shall remain open for

signature from January 15, 1974 until December 31, 1974 at the

Headquarters of the Organization.

    2. Subject to paragraph 4 of this Article, the present Protocol shall

be subject to ratification. acceptance or approval by the States which

have signed it.

    3. Subject to paragraph 4, this Protocol shall be open for accession

by States which did not sign it.

    4. The present Protocol may be ratified, accepted, approved or acceded

to only by States which have ratified, accepted approved or acceded to the

Convention referred to in Article II.

      Article V

    

    1. Ratification, acceptance, approval or accession shall be effected

by the deposit of a formal instrument to that effect with the

Secretary-General of the Organization.

    2. Any instrument of ratification, acceptance, approval or accession

deposited after the entry into force of an amendment to the present

Protocol with respect to all existing Parties or after the completion of

all measures required for the entry into force of the amendment with

respect to all existing Parties shall be deemed to apply to the Protocol

as modified by the amendment.

 

            Article VI

    

    1. the present Protocol shall enter into force on the ninetieth day

following the date on which fifteen States have deposited instruments of

ratification, acceptance, approval or accession with the Secretary-General

of the Organization, provided however that the present Protocol shall not

enter into force before the Convention referred to in Article II has

entered into force.

    2. For each State which subsequently ratifies, accepts, approves or

accedes to it, the present Protocol shall enter into force on the

ninetieth day after the deposit by such State of the appropriate

instrument.

 

            Article VII

    

    1. The Present Protocol may be denounced by any Party at any time

after the date on which the Protocol enters into force for that Party.

    2. Denunciation shall be effected by the deposit of an instrument to

that effect with the Secretary-General of the Organization.

    3. Denunciation shall take effect one year, or such longer period as

may be specified in the instrument of denunciation after its deposit with

the Secretary-General of the Organization.

    4. Denunciation of the Convention referred to in Article II by a Party

shall be deemed to be a denunciation of the present Protocol by that

Party, Such denunciation shall take effect on the same day as the

denunciation of the Convention takes effect in accordance with paragraph 3

of Article XIII of that convention.

   Article VIII

    

    1. A conference for the purpose of revising or amending the present

Protocol may be convened by the Organisation.

    2. The Organization shall convene a conference of Parties to the

present Protocol for the purpose of revising or amending it at the request

of not less than one-third of the Parties.

 

            Article IX

    

    1. The present Protocol shall be deposited with the Secretary-General

of the Organization.

    2. The Secretary-General of the Organization shall:

        (a) inform all States which have signed the present Protocol or

acceded thereto of:

            (i) each new signature or deposit of an instrument together

with the date thereof;

            (ii) the date of entry into force of the present Protocol;

            (iii) the deposit of any instrument of denunciation of the

present Protocol together with the date on which the denunciation takes

effect;

            (iv) any amendments to the present Protocol or its Annex and

any objection or declaration of non-acceptance of the said amendment;

        (b) transmit certified true copies of the present Protocol to all

States which have signed the present Protocol or acceded thereto.

 

            Article X

    

    As soon as the present Protocol enters into force, a certified true

copy thereof shall be transmitted by the Secretary-General of the

Organization to the Secretarial of the United Nations for registration and

publication in accordance with Article 102 of the Charter of the United

Nations.

 

            Article XI

    

    The present Protocol is established in a single original in the

English, French, Russian and Spanish languages, all four texts being

equally authentic.

    In witness whereof the undersigned * being duly authorized for that

purpose have signed the present Protocol.
