YOU ARE HEREBY HELD RESPONSIBLE FOR THE ABOVE MENTIONED DAMAGES.

注:1、这是一份在码头被它船擦碰的碰撞通知书,以电传形式发出。如条件允许也可以信件形式发出并要求对方签收。
2、如在碰撞事故发生在海上,碰撞通知要扼要说明碰撞的大约时间、大致经纬度以及碰撞部位,再加上要求对方负责的字样即可,然后让对方船回电确认,并扼要记入航海日志。当然,对对方船的情况了解的越细越好,如船型、呼号、吨位、船旗、船级、船东、货物、来去港口、受损情况等。
3、对对方也要求我方签署同类文件,应加注received only字样。

I REGRET TO INFORM YOU THE FOLLOWING DAMAGE TO MY VESSEL CAUSED BY THE STEVEDORES DURING DISCHARGE AT XINGANG.
WHILE THE STEVEDORES DISCHARGING THE CARGO OF BULK WHEAT IN HOLD NO. 2 OF THE VESSEL ON 5TH MARCH 2001,THE WINCH OF THE SHORE CRANE WAS MISHANDLED OFR OUT OF ORDER AND THE GRAB dROPPED DOWN SUDDENLY ON THE TANK TOP,WHICH WAS SERIOUSLY DAMAGED. AFTER CHECKING A DENT OF ABOUT 500SQUARE CMS BY 10 CMS DEEP WAS FOUND ON THE TANK TOP PLATE.
THE DAMAGE WAS PURELY CAUSED BY THE STEVEDORES AND THEY SHOULD BE HELD FULLY LIABLE FOR THE DAMAGE. ON BEHALF OF THE OWENRS I HEREBY PUT YOU ON NOTICE OF THE DAMAGE AND REQUEST YOU TO ARRANGE FOR YOUR ACCOUNT REPAIRS OF THE DAMAGED PART TO MY SATISFACTION OR THAT OF A CLASS SURVEYOR PRIOR TO MY VESSEL'S DEPARTURE IN ACCORDANGE WITH THE GOVERNING CHARTER PARTY. SHOULD YOU FAIL TO EFFECT PROPER REPAIRS AND SHOULD I THEREFORE DECIDE TO DEPART IN ORDER TO MITIGATE LOSSES, YOU WILL REMAIN RESPONSIBLE FOR ACTUAL COSTS AND TIME LOST REPIRING THESE DAMAGES ELSEWHERE.

Dear Sirs,
Your are hereby informed that MV ABC,under my command, have got alongside berth ES-7 of Mombasa at 2020L on 5th May 1999. However during the berthing my vessel had great difficulties to get her starboard fully alongside even with two tugs assistance. Now the vessel is a bit listing to portside. In view of the above we believe that the depth of the berth is not suitable for my vessel and the vessel is temporarily getting grounded.
Therefore, on behalf of my owners I put you on notice that we reserve our right to claim for damages, if any, to the hull of my vessel due to your failure to arrange a safe berth. We will inform you to carry out a joint underwater inspection to the vessel if necessary at time and place convenient.
Meantime the surveyors are now on board intending to conduct the draft survey. Considering the vessel has got grounded and listed, the draft survey so conducted will not be correct. I suggest putting off the survey till the next high tide and vessel gets fully afloat, and time so lost should be counted as laytime. Otherwise owners shall not be liable for cargo shortage if any.

The vessel under my command sailed from Antwerp on March 6, 1999 and bound for Shanhai, via Bay of Biscay and arrived at the port of Port Said at 1500L 16th December 2002. During the present voyage my vessel has encountered the following sea conditions:
The ship encountered very heavy weather in the Bay of Biscay on the way from Antwerp to Port Said from December 3 to 6 1999 with southerly and westerly winds of strong gale force 9 to 10 of Beaufort scale. During the period the ship was pitching and rolling violently (even rolling to 35 degrees each side). (Although all means of safeguarding the vessel and the cargo were applied, including but not limited to decrease speed, sail a zigzag course or against the wind etc, so as to reduce the chances to be attacked by the very rough seas , the vessel was still maneuvering with great difficulties, and shipping seas over forecastle deck, hatch covers all the time and sometimes superstructures..)
Anticipating the possibility of loss of or damage to cargoes and the vessel as a result of the fore-said weather conditions, I hereby note my protest against all losses, damages etc, reserving my right to extend the same at time and place convenient.

The vessel sailed from Shanghai on March 6, 1999 and bound for Rotterdam for discharge the cargo of various minerals on board.
At about 0300L on 26th March 2002, while the 2nd engineer was on duty he heard an abnormal sound of the No 2 generator and after a few seconds smoke was found emitted from the crankcase and the engine was stopped immediately. Upon inspection by the crew, bearing white metal had squeezed out of the no. 3 unit crank pin bearing.
Fearing that the vessel might sustain losses and damages due to the above accident, I hereby note my protest against all losses, damages etc, reserving my right to extend the same at time and place convenient , and in the meantime reserve my right to claim against parties concerned.

The vessel sailed from Shanghai on March 6, 1999 and bound for Rotterdam for discharge the cargo of various minerals on board.
At about 0300L on 26th March 2002, while the 2nd engineer was on duty he heard an abnormal sound of the No 2 generator and after a few seconds smoke was found emitted from the crankcase and the engine was stopped immediately. Upon inspection by the crew,the damages sustained by the no. 2 generator were as follows:
1. Nos.1,2 and 4 main bearing shells were found severely wiped.
2. Nos.3 and 4 crank pin bearing shells were found severely wiped.
3. Nos.3 and 4 crank pins had severely scored.
Although the exact reason for the damages could not be ascertained at the moment, it might be due to water ingress since the oil sump level had increased and water was found leaking from no.2 liner. To repair the generator, the engine must be completely dismantled for renewal of the crankshaft.

注:1、海事声明是在事故发生后,未发现具体损坏项目前,为了保留以后索赔权利时使用的。也用于遇到大风浪后争取免除船方责任,主要是应对收发货人。此项声明必须在船到港后24小时内做出,或者在开舱卸货前起草好海事声明并得到签证。
2、事故报告是在事故(多为机损和货损事故)发生后已造成属于保险范围内具体损失时使用,专门用于对保险公司的报案及索赔用。对于我公司的船舶来说,目前可以按此格式用中文来书写事故报告。
根椐有关的法律规定,船方要对货物装船后处于船方保管照料期间的货物状况负责。因此,在大副收据及交货(卸货)报告上对货物在装船时及卸离船舶时的状况进行客观准确、公平合理的批注对处理货损索赔、保护船东利益至关重要。大副在具体批注时应注意到:
1、 内容具体、肯定、确切、不含糊其词模棱两可;
2、 不必重复提单中的免责条款;
3、 对于贵重物品,船方值班人员要加强对货物的监督、检查,凡有缺陷一定准确加一批注:
4、 对于船厂东或保赔协会已安排装前或卸后检验的货物,如钢铁制品(螺纹钢、钢管等),大副在签批注时一定要征求检验人员的意见。
大副收据(袋货及散货)常见的批注
1、 发货人重量,船方不负责货物重量

2、 根据发货人(租船人)要求积载,船方对其后果不承担责任。

I, the master of MV Hebei Progress, declared my vessel’s DWCC 49,500 metric tons for the cargo of coke in bulk to be loaded at Xingang under the current voyage on the basis of stowage factor 65 (pursuant to the governing charter party)/(provided by Charterers).
However, upon completion of loading at XXX on XXX, it came out that only XXX metric tons had been loaded onboard as per draft survey, XXX metric tons less than my foregoing declared DWCC. (No more cargo was available and my vessel was arranged to sail at XXX on XXX although my vessel still had enough capacity to receive the balance cargo.)
In view of the above facts, I, on behalf of my owners and XXXX, herby tender my protest against parties concerned, reserving rights to claim against them for the dead freight and other loss whatsoever so caused.
